Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: The 30-day period during which the consumer may exercise the right of withdrawal.
Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Long-term transaction: A distance contract relating to a series of products or services for which the delivery obligations are spread over time.
Right of withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: Skinea, the natural or legal person offering products to consumers at a distance.
Distance contract: A contract concluded between Skinea and the consumer using one or more means of remote communication.
CESOP: The Central Electronic System of Payment Information, introduced by the EU to monitor payment service providers.

Article 3 – Applicability

These terms and conditions apply to every offer from Skinea and to every distance contract concluded between Skinea and the consumer.
Before the agreement is finalized, these terms and conditions will be provided to the consumer electronically or through another appropriate method.

Article 4 – The Offer

All offers from Skinea are non-binding. Skinea reserves the right to modify or withdraw offers at any time.
The offer clearly specifies the total price, including shipping costs and any applicable taxes or fees.
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

Article 5 – The Agreement

The agreement is established when the consumer accepts the offer and fulfills the stated conditions.
Skinea confirms the consumer’s acceptance by email.
Skinea reserves the right to refuse orders without obligation to specify a reason.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days of receiving the product, without providing any reason.
The costs of return shipping are the responsibility of the consumer.
The consumer must handle the product with care during the cooling-off period and only inspect it as reasonably necessary.

Article 7 – Costs in Case of Withdrawal

Skinea refunds all payments received from the consumer within 30 days after receiving the withdrawal notice, provided the returned product is received in its original condition and packaging.
If the product is damaged due to consumer misuse, Skinea reserves the right to deduct an appropriate amount from the refund.

Article 8 – Customs, Import Duties, and Taxes (International & U.S. Orders)

8.1
All international orders, including shipments to the United States, are shipped under the delivery term Delivered Duty Unpaid (DDU). This means that the customer is responsible for any import-related costs when the shipment arrives in the destination country.

8.2
Import-related obligations may include, but are not limited to:

payment of import duties, VAT, sales tax, or government-imposed charges;
customs clearance fees such as brokerage, handling, or administrative fees charged by couriers or customs authorities;
compliance with local laws, regulations, and product requirements in the destination country.

8.3 – United States Orders
Most U.S. orders with a total value under $800 USD typically enter duty-free under the U.S. de minimis import rule.
However, Skinea does not guarantee tax-free entry. Any duties, taxes, or clearance fees imposed by U.S. Customs or the carrier remain the customer’s responsibility.

8.4
Skinea does not act as the importer of record for international shipments. Ownership and responsibility transfer to the customer once the order has been shipped. Skinea is not liable for delays, holds, seizures, or additional costs resulting from customs processing or failure by the customer to comply with regulations.

8.5
Skinea provides standard shipping documentation (such as product description, value, and invoice), but cannot guarantee that these documents meet the specific requirements of every destination country.

8.6
The customer indemnifies Skinea from all financial consequences, claims, penalties, or delays caused by non-compliance with import rules in the destination country.

Consumers are strongly advised to contact local customs authorities before placing an order to avoid unexpected costs or delays.

Article 9 – CESOP Compliance

From 2024 onwards, payment service providers record transaction data in the European CESOP system. Skinea complies with these obligations, which may impact the monitoring and reporting of payments.

Article 10 – Conformity and Warranty

Skinea guarantees that the delivered products comply with the agreement and meet normal quality standards.
Complaints regarding defects must be reported in writing within 14 days of receipt.
Returned items must be sent in their original condition and packaging.
Improper use or damage caused by the consumer voids any warranty.

Article 11 – Delivery

Orders are delivered within 30 days, unless otherwise agreed.
In case of delays, the consumer will be informed within 14 days after placing the order.
Skinea adheres to international shipping standards but is not responsible for customs delays.
Failure to comply with import obligations does not entitle the consumer to cancellation or refunds.

Article 12 – Complaints Procedure

Complaints must be submitted in writing within 7 days after the consumer discovers the issue.
Skinea responds within 14 days. If a complaint requires more time, Skinea will provide an estimated resolution timeframe.

Article 13 – Disputes

These terms and conditions are governed by Dutch law.
Disputes will be resolved preferably through mutual agreement. If necessary, disputes will be submitted to the competent court in the Netherlands.
